New York Construction Accident Laws

Thousands of tradesmen and tradeswomen are injured or killed at construction sites each year. According to OSHA, the fatal injury rate for the construction industry is higher than the national average in this category for all industries.

Labor Law 240(1) requires that “All contractors and owners and their agents, except owners of one and two-family dwellings who contract for but do not direct or control the work, in the erection, demolition, repairing, altering, painting, cleaning or pointing of a building or structure shall furnish or erect, or cause to be furnished or erected for the performance of such labor, scaffolding, hoists, stays, ladders, slings, hangers, blocks, pulleys, braces, irons, ropes, and other devices which shall be so constructed, placed and operated as to give proper protection to a person so employed.”

Labor law 241(6) generally protects workers engaged in the same types of construction work as those that are protected by labor law section 240(1), and it is not limited to construction accidents that are height or gravity-related. New York Labor Law 241 (6) places the responsibility of maintaining adequate worksite safety on the general contractor and the property owner. Property owners and general contractors are responsible for complying with specific safety rules and may be liable if violations of the rules occurred during the construction or demolition of a building or during an excavation.
